1. Who is responsible

Niffsee Digital Design Services (“Niffsee,” “we,” “us”) is responsible for personal information it collects through niffsee.com, inquiries, orders, and Niffsee-hosted digital profiles, subject to applicable Philippine law, including Republic Act No. 10173 (Data Privacy Act of 2012) and its implementing rules.

2. Information we collect

Depending on how you use Niffsee, we may collect information you submit, such as your name, email address, phone/contact number, order and payment status, delivery details, selected product/price tier, quantity, design brief, NFC destination, customer-provided URL, messages, and profile content you ask us to publish. Please do not send passwords, full payment-card details, government IDs, or sensitive personal information unless we specifically explain why it is required and provide a secure method.

Our website hosting and security systems may also process technical information such as IP address, browser/device information, access times, and diagnostic logs.

3. Why and on what basis we use information

Depending on the activity, processing may be necessary to take steps at your request before a contract, perform a contract, comply with a legal obligation, pursue a legitimate purpose permitted by law, or rely on consent where required. We will not treat consent as the only possible lawful basis in every situation.

4. Niffsee-hosted profiles and public links

Profiles and links you ask us to make public may be viewable by anyone who has the link or taps/scans the associated NFC tag. You are responsible for ensuring you have authority to submit content and that it does not disclose another person’s information without an appropriate basis. Avoid placing private or sensitive details in a public profile.

You may ask us to edit, deactivate, or delete your profile by emailing [email protected]. We may request reasonable verification to prevent unauthorized changes. Deactivation may stop public access while retaining limited records; deletion from active systems may not immediately remove copies held in backups, logs, or third-party systems, and some records may need to be retained by law or for legitimate claims.

5. Payments

Niffsee may accept payment through banks, digital wallets, payment services, and pera-padala/remittance services, as agreed for the particular order. Payment processing may involve the relevant provider and its own privacy terms. We do not intend to collect or store your payment account password, PIN, or full card credentials. Keep payment references and receipts; do not email secret authentication codes.

6. Sharing and service providers

We may share only information reasonably needed with service providers that help operate the website, manage inquiries, store records, communicate with you, process payments, or deliver orders. These may include website/hosting providers, Google Sheets/Google Apps Script or similar business tools, email providers, payment providers, and delivery services. We may disclose information when required by law or to establish, exercise, or defend legal claims. We do not sell personal information.

7. Cookies and analytics

As of the effective date, Google Analytics or similar analytics is planned but not yet active. If analytics or non-essential cookies are enabled later, we will update this notice and provide any consent or preference controls required by law. Basic technical logs necessary for site operation or security may still be processed by hosting providers.

8. Retention

We retain inquiry records for up to 12 months after the inquiry is closed if no order results, unless a longer period is reasonably needed for a follow-up you request, security, or a legal claim. For completed orders, accounting, tax, and transaction records, our working retention schedule is generally up to 5 years from the end of the relevant transaction/tax period, or longer where applicable law, an audit, dispute, or legal hold requires it. Profile content is retained while the profile is active or until a verified deletion request is completed, subject to limited backup and legal-record exceptions. We securely delete, anonymize, or otherwise dispose of information when no longer needed, subject to these exceptions.

9. Security

We use reasonable administrative, physical, and technical safeguards appropriate to the information and risks. No internet transmission or storage system can be guaranteed completely secure. If a personal data breach occurs, we will assess and notify the National Privacy Commission and affected individuals when required by law.

10. Your rights

Subject to applicable law and its exceptions, you may request information about processing, access, correction, objection, blocking/erasure, or data portability where applicable, and may lodge a complaint with the National Privacy Commission. To make a request, email [email protected] with “Privacy Request” in the subject. We may ask for identity verification and will respond within the period required by law.

11. Children and profiles for minors

Where a profile concerns a minor, a parent or legal guardian should submit and manage the request, provide only necessary information, and ensure any public content is appropriate. We may decline or remove information where consent, authority, or safety is unclear.

We may revise this policy as services or laws change. The current version and effective date will be posted on this page.
